In the case of Kulbhushan Jadhav, the International Court of Hague (ICJ) will hear its verdict tomorrow. On Thursday, the ICJ will announce its decision on this very important issue at 3:30 PM on Thursday. The case was heard on Monday. Senior advocate Harish Salve, on behalf of India, spoke about it.
In a hearing in the court, India said that hearing of this case within seven days of India’s appeal tells how much the international court is taking up the serials. Salve said that Pakistan did not help Kulbhushan Jadhav, I want to tell from India that 125 million people of India are looking for the return of Kulbhushan Jadhav.
We want Pakistan’s military court’s decision to be banned without any hearing. Pakistan violated the Vienna Treaty, under which he did not allow Kulbhushan Jadhav to meet anyone. The execution of Kulbhushan Jadhav is a human rights violation. India said neither kulbhushan Jadhav helped nor helped any counselor.
Despite India’s sayings, Pakistan did not give us any information related to Kulbhushan Jadhav, Jadhav’s parents came to Pakistan and wanted to meet their son, they also asked for it, but Pakistan did not respond. Our demand is that Kulbhushan Jadhav should not be hanged on the basis of the trial of the military court only.
Kulbhushan Jadhav’s parents are unable to help him, but still Pakistan is not giving any information. On April 27, India again raised this issue in front of Pakistan but Pakistan did not listen to us. The Military Court of Pakistan has already been making such decisions before, and they are brought to justice without any challenge.
The Indian representative said that under the Vienna Treaty, it has been said that if a person is caught, then both countries will get help under the political rules, as mentioned in article 36. India is not hurting the judicial system of any other country, we are just talking about international rules. Pakistan must obey the rules.
In the first paragraph of Article 36, it has also been mentioned that in this case the challenge can be challenged in the International Court. India and Pakistan are members of the United Nations and both countries are committed to following the rules of the Vienna Treaty. According to the treaty it has been said that the International Court can resolve this if any differences arise.
There is a two-party treaty between India and Pakistan, which is being discussed in the Vienna Treaty. This case did not come under two-party rules, so it had to be brought to the International Court. Under this agreement, the agreement was reached in 2008.
