In Pakistan SC, filed a petition in the Supreme Court for quick execution of Kulbhushan Jadhav

    In Pakistan a lawyer, Mujmil Ali, filed a petition in the Supreme Court for quick execution of Kulbhushan Jadhav. It has said that there is no compulsion on Pakistan in case of ICJ order, Kulbhushan. This does not affect the case under domestic law of the country. The petition has been filed under Article 184 (3) of the Constitution of Pakistan. In this petition, the Court of Appeal constituted under the provincial government, the internal and law secretary, and the Pakistan Army Act (PPA) 1952 has been made a Respondent.
    Jadhav’s death sentence is given by military courts, which has been established by the parliament of Pakistan through constitutional amendment. The Parliament recently gave extension to the courts for two years and focused primarily on dealing with cases of terrorism. The case filed in the Supreme Court is an attempt to support Jadhav’s case under the legal system of the country, as the petitioner has asked the Supreme Court to declare that the decisions on Jadhav’s trial were given in accordance with the law in Pakistan. .
    It may be noted that the international court has banned Kulbhushan Jadhav’s hanging. Jadhav has been sentenced to death by the military court of Pakistan. No legal help is being given to him by the Pakistani government nor any information about him is being given to his family. Jadhav is not being given to meet. Pakistan claims that Kulbhushan Jadhav is an Indian spy who was arrested in Pakistan, while India is calling Jadhav a former officer of the Indian Navy who was arrested from Iran.
    Pakistan claims that its security agencies had caught Jadhav from Balochistan in March last year. Pakistan tells Jadhav the spy of India. It is alleged that Jadhav was involved in efforts to destabilize Balochistan. India dismissed these claims and clarified that Jadhav was abducted from Iran. Even after India has repeatedly appealed, Pakistan has not provided Jadhav to the advocate.
