LIVE: ICJ’s ban on the hanging of Jadhav, said- Pak’s claim of being a spy can not be considered right

    In the case of Kulbhushan Jadhav, the International Court of Justice has recently given its verdict. Court has now banned the execution of Kulbhushan. Before the verdict, the court said that according to the Vienna Treaty, Jadhav should have received councilor access. The court dismissed almost all of the arguments put on behalf of Pakistan in the case.
    The international court said when both the countries had signed the Vienna Treaty, then Jadhav’s demand for counselor access should have been heard. According to the court, it is not yet decided whether Jadhav was a terrorist or not. After this, the court ordered that Pakistan would not allow Jadhav to hang until he heard a decision in this regard.

    Explain that during the hearing, India had sought Kulbhushan Jadhav to end the sentence awarded to him by Pakistan. India feared that Jadhav could be hanged before the hearing was over. Jadhav, 46, a former naval officer of the Indian Navy, was arrested on 3 March by Pakistan.
    Pakistan had sentenced Jadhav to hang himself and accuse him of involvement in sedition action. India had strongly objected and said that Jadhav was abducted.

    On refusing to stop the execution of hanging and not allowing diplomatic access to Jadhav, India took the case to international court. On May 8, while filing the case, India had accused Pakistan of violating the Vienna Agreement on Jadhav issue.

    India had said that Pakistan has no evidence against Jadhav. He is being hanged on the basis of fake charges. On the other hand, Pakistan had said that there is no provision to grant diplomatic access to the spy involved in terror activities under the Vienna Agreement which is accusing India of violating India.

    He accused the issue of using it as a political weapon against Pakistan on the international stage. Last time, in the international court, India faced Pakistan 18 years ago.

     

    India’s plea
    Pakistan has violated the Vienna Agreement by imposing Jadhav’s death sentence. There is no evidence against Jadhav. He is being hanged on the basis of fake charges.
    Logic of Pakistan
    There is no provision to grant diplomatic access to detectives involved in terrorist activities under which the Vienna Agreement is accusing India of infringement.
    What is the accusation
    On Jadhav, Pakistan has accused the spying and involvement in subversion activities.
