new delhi:The problem of RJD leader Lalu Yadav in the case of fodder scam has increased further. The Supreme Court has approved the CBI appeal in the Devgarh treasury case. The CBI had appealed against the decision of Jharkhand High Court.
The verdict of the Supreme Court means that there will be a separate case against Lalu Yadav in Devghar case.
Lalu will be prosecuted in these sections:
120-B criminal conspiracy
409 – Khayanat in Amanat
420- Fraud
467- Phishing
468 – Fraud for Fraud
Apart from this, there will be a lawsuit under section 13 (1) CD and 13 (2) of the Prevention of Corruption Act.
The Supreme Court has also criticized the decision of Jharkhand High Court in its decision.
This was Jharkhand High Court decision
The Jharkhand High Court had removed the serious currents while giving relief to Lalu Yadav in 2014.
Based on Section 300 of the CRPC, this order was passed by the High Court. The Jharkhand High Court had removed these streams saying that the case against Lalu in the second case of the fodder scam has led to the trial. So again, the lawsuit can not be prosecuted under these sections.
While the CBI had said that the two cases were different. In both cases separate conspiracy was hatched, conspiracy from different treasury funds was withdrawn. Therefore, both cases should run separately.
Instructions to complete the investigation in 9 months
The Bench of Supreme Court Justice Arun Mishra and Justice Amitva Roy, while deciding the verdict, directed the trial court to complete the hearing in 9 months.
The bench, while holding the CBI, said that why the CBI filed a late appeal in this case. The court directed the CBI director to avoid such negligence in the future.
